Understanding The Parenting Plan
A parenting plan is a legal document that explains the custody rights and responsibilities each parent has to their children. Parents can decide the terms of their agreement and have the final parenting plan approved by the judge, so long as the agreement is in the child’s best interest. If parents cannot come to an agreement, a judge will make the decision based on best interest factors, including but not limited to each parent’s ability to have a healthy relationship with the other parent and the children. The agreement or order of the court must be based on the best interests of the children.
Here are a few common parts of a parenting plan:
- Parenting time The parenting plan will set forth each parent’s parenting time, which is the actual division of time each parent spends with the children. Parenting time includes the normal residence schedule, holidays, and vacation time the children will spend with each parent.
- Legal custody The parenting plan also defines legal custody and how the parents will make major decisions about the child’s life. This includes decisions regarding the child’s health, education and welfare. One parent may have sole legal custody, but most often parties will have equal decision-making ability and joint legal custody.
